These terms and conditions, which may be amended from time to time, apply to all our services, directly or indirectly (through distributors) made available online, by email, or by telephone. By accessing, browsing, and using our website and completing a booking, you acknowledge and consent that you have read, understood, and agreed to the terms and conditions below (including the privacy statement).
Its content and infrastructure and the online accommodation booking service provided through this website are owned, operated, and provided by Sem Rumo, Exploração Turística e Hoteleira Lda and are made available for your personal and non-commercial use only, subject to the terms and conditions set out below.
Umbral, shall be construed as Sem Rumo, Exploração Turística e Hoteleira Lda, a limited liability company incorporated under the laws of Portugal, registered in Albufeira, Portugal.
“Platform” means the Website where the Service is made available, owned, controlled, managed, maintained, and/or hosted by Umbral.
“Service” means the online booking service (including the facilitation of payments) for various products and services that are made available over time on our Platform.
“Provider” means the hotels, (theme) parks, attractions, excursions, boat trips, transport services, and any other travel-related products and services that are made available and bookable on our Platform.
Through the Platform, we at Umbral and its partners provide an online platform through which our products and services are publicised for booking, and through which visitors to the Platform can make such bookings. When you make a booking through Umbral, you enter into a direct contractual relationship with the Provider with whom you make the booking or purchase the product or service. From the moment you make the booking, we only act as an intermediary between you and the Provider, transmitting the details of your booking to the Provider in question and sending you a confirmation email on behalf of the Provider.
In providing our services, the information we disclose is based on the information provided to us by the Providers.
Our service is made available for personal, non-commercial use only. Therefore, you are not permitted to sell, hyperlink, use, copy, monitor, display, download, or reproduce any content or information, software, bookings, tickets, products, or services available on our Platform for any commercial or competitive activity or purpose.
The prices on our Platform are highly competitive. All prices are shown per room for the full stay, including VAT and all other taxes (such taxes are subject to change) unless otherwise stated on our Platform or in the confirmation email or ticket. Ticket prices are per person and are subject to the validity stated on the ticket itself, if applicable. Applicable taxes and fees (including tourist or municipal tax) may be charged by the Provider in the event of a no-show or cancellation. The accommodation may charge additional costs in the event of no-show or cancellation fees.
Sometimes there are cheaper rates available on our Platform for a specific stay, product, or service, however, these established rates may carry restrictions and special conditions, for example regarding cancellation and refund conditions. Please check the product, service, and booking conditions and information carefully before making your booking.
Obvious errors and misunderstandings (including misprints) are not binding.

If applicable and available, there is the possibility for bookings to be paid (in full or in part and as required by the accommodation’s payment terms) to Umbral during the booking process via secure online payment methods (provided by you). Payment is processed securely from your credit card or bank account to Umbral’s bank account. Any payment facilitated in this way will, in each case, constitute a payment of the reservation price by you of the relevant product or service in the final settlement corresponding to the price due and in full, and you cannot reclaim any such amounts paid.
Umbral will provide Customer Service in the event of questions relating to a booking paid for by credit card.
For certain rates or special offers (i.e. non-refundable), please note that Providers may require payment to be made in advance by bank transfer (if available) or by credit card, and your credit card may be pre-authorized or charged (sometimes without any refund option) after booking. Please check the (booking) information for your chosen product or service in detail to be aware of all the conditions before making your reservation.
In the event of fraud or unauthorized use of your credit card by a third party, most banks and credit card issuers cover all charges resulting from such fraud or misuse, which can sometimes be subject to a deductible (usually 50.00Eur (or the equivalent of your local currency). To compensate you, please ensure that you report this fraud to your credit card provider (by their rules and procedures) and contact us immediately by email reservations@byumbral.com). Please indicate “credit card fraud” as the subject of your email and provide us with proof of the excess charged (i.e. credit card provider’s conditions). This indemnity applies only to bookings made with a credit card via the Umbral secure server and when the unauthorized use of the credit card is not the result of an error on your part in using the server, but of an error or negligence on our part.
By making a reservation, you accept and agree to the relevant cancellation and no-show conditions and any additional terms and conditions that may apply to your stay (available on our Platform). The general cancellation and no-show conditions of each hotel are made available on our Platform, during the booking process and in the confirmation email. Please note that certain rates or special offers cannot be canceled or changed.
Please check the room description carefully before booking. In the event of cancellation or no-show, tourist tax may also be charged (if applicable). Please check the (booking) information of your chosen product or service carefully to check these conditions before making your reservation. Cancellation and payment conditions may vary according to the type of room. Please read the important clauses and information on your booking confirmation carefully for additional conditions that may apply (for example; regarding age, deposit, extra beds, free breakfast, pets). Late payment, invalid credit card details, or insufficient balance may result in no right to claim any refund of (non-refundable) prepayments.
If you wish to review, adjust, or cancel your booking, please check the confirmation email and follow the instructions. Please note that the accommodation may charge you for cancellations, prepayments, and no-shows, according to the conditions in force at the accommodation; or you may not be entitled to any refund of prepaid amounts. We recommend that you read the cancellation conditions carefully before making your reservation. Please remember that you must make any future payments due on time, as required by the booking in question.
In the event of a late arrival or a delay in the check-in date or arrival the following day, please make sure you inform the hotel in good time so that it knows your arrival time and can avoid cancellation of your room or a no-show charge. If you need our customer service, you can inform the hotel. Umbral is not responsible for the consequences related to your delay or any cancellation or no-show fees charged.
By completing a booking, you agree to receive an email that may be sent to you shortly before your arrival date, which will give you information about your destination and provide certain information relevant to your booking and destination.

Umbral disclaims any liability related to direct communication with the hotel. You cannot benefit from any rights resulting from requests or communications with the hotel. Umbral cannot guarantee that requests or communications will be (duly/timely) received/read, fulfilled, executed, or accepted by the hotel.
To properly complete and guarantee your booking, you must use the correct email address. We are not responsible if any information is incorrect or misspelled in emails, telephone numbers, and credit card numbers.
Any complaint or claim against Umbral or about the Service must be submitted immediately and, in any case, within 15 days of the date of departure. Any claim or complaint filed after the 15 days may be rejected and the complainant will lose the right to any compensation (if any).
Due to regular updates and adjustments to rates and availability, we recommend taking screenshots when booking, in case you need to prove your position.
Customer comments may be inserted on the page of the hotel in question on our Platform for the sole purpose of informing (future) customers of their opinion of the service and quality of the hotel in question and maybe (totally or partially) used and placed by Umbral at its sole discretion on our Platform. We reserve the right to adjust, refuse, or remove comments at our discretion.
By the limitations set out in these terms and conditions to the extent permitted by law, we shall only be liable for direct damages suffered, paid, or incurred by you due to an attributable failure of our obligations in respect of our services, up to a total amount of the overall cost of your booking as specified in the confirmation email.
However, and to the extent permitted by law, we shall not be liable for any punitive, special, indirect, or consequential damages or losses, any injury, death, damage to property, strikes, force majeure events, or any other event beyond our control.
If Umbral charges for your room, product, or service, or if you have facilitated the payment of the amount, you agree and accept that the hotel shall at all times be responsible for collecting, withholding, deducting, and paying applicable taxes on the total amount to the relevant tax authorities.
Unless otherwise stated, the software required for our services, available on or used by our Platform, and the intellectual property rights (including copyright) in the content, information, and material on our Platform are owned by Umbral.
Umbral has exclusive ownership of all rights, title, and interest in and to (all intellectual property rights) (the design and appearance (including infrastructure)) of the Platform on which the service is made available and therefore does not grant you any right to copy, alter, publish, promote, advertise, commercialize, integrate, utilize, combine or otherwise use the content or our brand without our express written permission. Any unlawful use of any of the above actions or behaviors will constitute a material infringement of our intellectual property rights (including database rights and copyright).
To the extent permitted by law, these terms and conditions and the performance of our services shall be governed by and construed by Portuguese law and any dispute arising out of these general terms and conditions of our services shall be exclusively submitted to the competent courts of Portugal.
The original Portuguese version of these terms and conditions may have been translated into other languages. The translated version is a courtesy and an office translation only, from which you may not derive any rights. In the event of a dispute over the content or interpretation of these terms and conditions or inconsistency or discrepancy between the Portuguese version and any other language version of these terms and conditions, the Portuguese version shall prevail and be conclusive to the extent permitted by law.
